The User acknowledges that he/she is of legal age and has sufficient legal capacity to be contractually bound by these General Terms and Conditions. By checking the acceptance box or performing any electronic confirmation action when registering on the Website, the User signifies consent and acceptance of these General Terms and Conditions.

2. SERVICES

Zertia offers through this Website informative and educational content in various areas. Zertia reserves the right to modify the available Services, suspend or discontinue their availability at any time and without prior notice.

The contents provided are for informational and educational purposes only and should not be construed as professional advice or a guarantee of specific results. The User is solely responsible for evaluating the adequacy, accuracy, completeness and usefulness of any information or content provided on this Website.

3. WEBSITE REGISTRATION

The use of the Services shall be subject to the User passing the registration process and creating an account. To proceed with the registration, the User shall provide the required information, accept these General Terms and Conditions, and follow the steps for Account confirmation.

The User shall be responsible for maintaining the security and confidentiality of his or her access credentials. In the event of loss or fraudulent use of the access credentials, the User must notify Zertia so that it can implement the necessary measures to protect the Account.

4. PRICE AND PAYMENT TERMS

The Services provided by Zertia are free of charge. Zertia reserves the right, at its sole discretion, to modify the prices of the Services at any time and without prior notice.

5. RIGHT OF WITHDRAWAL

The User does not have the status of consumer because there is no economic consideration, therefore the right of withdrawal does not apply.

6. CANCELLATION OF THE ACCOUNT

In case the User wishes to delete his/her Account, he/she should send an email to hello@zertia.ai, requesting the cancellation of the registration. In a period not exceeding 48 working hours the effective cancellation of the Account will be processed.

Upon cancellation of the Account, the User will lose access to the Services associated with the Account, and all data and content related to the Account may be deleted. The cancellation of the Account will not give rise to refunds for contracted services.

7. INTELLECTUAL PROPERTY AND TERMS OF USE

Zertia is the owner (or the lawful licensee) of all intellectual and industrial property rights related to all components of the Services, including the Website and any material or element made available to the User.

Zertia grants the User the right to use the Website and Services on a non-exclusive, non-sublicensable and non-transferable basis, exclusively for personal use or internal purposes.

The User shall refrain from any action that implies contravening the applicable legislation and, in particular, shall refrain from:

• Accessing or using the Website and/or the Services for illicit purposes or harmful to the rights of third parties.
• Employing any type of computer virus, code, software or computer program that may cause unauthorized damage to Zertia’s content, programs or systems.
• Reproducing, distributing, copying, or commercially exploiting all or part of the contents and Services without prior written authorization from Zertia.
• Creating different Accounts on the Website to unduly benefit from discounts and promotions.

8. PROTECTION OF PERSONAL DATA

Personal data will be collected and processed by Zertia in accordance with the Privacy Policy. In the event that the Services are contracted by a legal entity and Zertia is deemed to act as a processor of personal data, a corresponding processor agreement may be requested by contacting hello@zertia.ai.

9. WEBSITE AVAILABILITY AND TECHNICAL SUPPORT

Zertia undertakes to make all reasonable efforts to ensure the continuous availability of the Website and the Services. However, the User acknowledges that, from time to time, interruptions may occur. Zertia will endeavor to notify the User in advance of scheduled interruptions whenever possible.

10. REPRESENTATIONS AND WARRANTIES

Zertia represents and warrants that it is the owner or rightful holder of all intellectual property rights in the Website and Services and that their use by the User does not infringe any intellectual property rights of any third party.

Zertia does not offer any guarantee that the contents or materials provided as part of the Services will ensure specific results for the User, since their purpose is exclusively informative.

11. LIMITATION OF LIABILITIES

To the extent permitted by law, Zertia shall not be liable for any loss, damage or claim arising from the use of the Website and the Services, except in cases of Zertia’s fault or negligence.

In any event, Zertia’s total liability to User for any claim related to the Services shall be limited to the amount paid by User to Zertia in the twelve months prior to the event giving rise to the liability.

12. DURATION

These General Terms and Conditions shall enter into force upon acceptance by the User and shall be of indefinite duration unless the Account is cancelled. Subscription durations will be established according to the type of product or services selected by the User during the contracting process.

13. MISCELLANY

All communications between Zertia and the User shall be made in writing, preferably through the User’s Account or by e-mail. Zertia reserves the right to modify these General Terms and Conditions at any time, notifying the User in writing at least thirty (30) days prior to the effective date of the new Conditions.

14. APPLICABLE LAW AND JURISDICTION

This Agreement and its execution shall be subject to Spanish law. In the event of any dispute, the Parties shall submit to the courts or tribunals of the city of Madrid, unless the User is a consumer, in which case the Parties shall submit to the courts or tribunals of the User’s domicile.
